Police officers jailed for contempt of court

Three senior police officers and a Grama Niladhari were sentenced to five years imprisonment for contempt of court after producing false report in the Puttalam High Court with regard to arrest warrants issued on two accused.
Puttalam High Court Judge Gamini Sarath Edirisinghe imposed five year jail terms on former Puttalam Police Headquarters Inspector, Y. P. Gunaratne, Anamaduwa Police OIC, Inspector H. R. A. Bandara, Sergeant H. M. Rohana Herath and the Anamaduwa Grama Niladhari, R. I. B. Rathnamalla. Each of the accused were also imposed a fine of Rs. 5000 or, in default, one year’s RI.
In one case, the Puttalam HQI and Sergeant H. M. Rohana, the officer who served warrants, were sentenced to five years imprisonment for forwarding a false report to court after an order was issued to arrest a murder suspect. The High Court judge had issued a warrant on A. R. M. Mashrook, accused of the murder of A. M. M. Rizwan. The police officers had forwarded a false report to court stating that the accused had left the area, whereas he (the accused) was staying at the residence of Deputy Minister, K. A. Baiz.
In a similar incident, the Anamaduwa Police OIC and the Grama Niladhari of Anamaduwa were found guilty of contempt for failing to carry out a court order to arrest an accused who was indicted with keeping a firearm in his possession.
Court had issued a warrant on R. M. Nimalsiri, alias Ratnayake, who was wanted in connection with keeping a firearm in his possession.
Court had issued a warrant as he was absconding. The Anamaduwa OIC and Grama Sevaka had forwarded a false report stating that the accused had left the area, whereas he was hiding in the residence of former minister D. M. Dasanayake.
Court refused bail applications filed on behalf of the accused and imposed five year jail terms.
Senior State Counsel Gihan Kulatunga, with State Counsel Kashyapa Wickremasekara, appeared for the prosecution. Thilina Wijesinghe with R. D. S. Rajapaksa and Mohamed Iqbal appeared for the defence.
